Solaria (“Solaria,” “we,” “us,” or “our”) provides a software platform and related services that help customers market and run their businesses. This Privacy Policy explains how we collect, use, disclose, and protect Personal Information when you visit our websites, use our application, or otherwise interact with us (collectively, the “Services”).
If you are a Solaria customer, this Privacy Policy is incorporated by reference into our Terms of Service. By using the Services, you agree to this Privacy Policy.
1. Who We Are & Roles under Privacy Laws
Controller (B2B relationships): We act as a controller for information we collect about you as a website visitor, prospect, customer admin/user, or billing contact.
Processor/Service Provider (your end-users/contacts): When you import or collect data about your own contacts, leads, and customers into Solaria, you are the controller of that data. We process it on your instructions as your processor/service provider.

2. Personal Information We Collect
We may collect the following categories (depending on how you use Solaria):
Identifiers & Contact: name, email, phone, address, company, role.
Account & Billing: login credentials, subscription tier, payment method details (processed by our payment processors), invoices, transaction history.
Platform Usage/Device Data: IP address, device and browser type, activity logs, pages viewed, timestamps, campaign metadata, approximate location (from IP), cookies and similar tech.
Content & Uploads: assets you upload (e.g., images, copy, lists), fields you configure, custom objects, campaign settings, automations.
Support & Comms: messages to support, survey responses, feedback, testimonials.
SMS/Email Program Data: opt-in/opt-out records, delivery and engagement events (opens, clicks, bounces), message content you send through Solaria.
We do not intentionally collect sensitive personal information (e.g., health, precise geolocation, union membership) unless you or your end users submit it to the platform. Please avoid uploading sensitive data unnecessarily.
3. How We Collect Information
Directly from you: forms, signup, chat/support, purchase, in-app settings.
Automatically: cookies, pixels, SDKs, and server logs when you interact with our sites/app.
From integrations/partners you connect: e.g., payment processors, ad platforms, calendars, social networks, or other tools you choose to sync.
From your use of messaging features: email/SMS metadata and performance signals.
4. How We Use Personal Information
We use Personal Information to:
Provide, maintain, and improve the Services; operate automations you configure.
Authenticate users; secure accounts; prevent fraud/abuse.
Process payments and manage subscriptions.
Provide customer support and communicate about updates, security alerts, and policy changes.
Analyze usage to improve features and user experience.
Help you run your marketing programs (sending your emails/SMS on your instructions).
Comply with law and enforce our Terms.
Marketing: With your consent where required, we may send Solaria product updates, offers, and newsletters. You can unsubscribe at any time.
5. Legal Bases (GDPR/UK GDPR)
Where applicable, our legal bases include: contract (to deliver the Services), legitimate interests (e.g., improve, secure, and support the Services), consent (e.g., certain marketing/cookies), and legal obligation (e.g., tax, regulatory).
6. SMS (TCPA/CTIA) & Email Compliance
If you opt in to receive SMS from Solaria or from a Solaria customer:
You consent to receive recurring messages; message & data rates may apply.
Reply STOP to opt out; HELP for help.
We record opt-in/opt-out status and program metadata to honor consent and compliance.
For email, you may unsubscribe via the footer link or your account settings. Customers are responsible for obtaining and honoring consent for messages they send to their own contacts via Solaria.
7. Cookies & Similar Technologies
We use cookies and similar technologies to operate the site/app, keep you signed in, remember preferences, analyze performance, and support advertising/attribution.
Your choices:
Use our cookie banner (where shown) to manage preferences.
Browser settings can block/delete cookies (site functionality may be limited).
We may use analytics and advertising tools (e.g., attribution pixels) to measure performance and improve the Services. Where required, we’ll ask for consent.
8. Disclosures of Personal Information
We may disclose Personal Information to:
Service providers/processors that help us run Solaria (e.g., hosting, infrastructure, analytics, customer support, email/SMS delivery, payment processing).
Payment processors (e.g., Stripe) to process transactions.
Underlying platform providers (e.g., CRM/marketing infrastructure providers) necessary to operate Solaria.
Your connected integrations at your direction.
Professional advisors (lawyers, auditors, insurers) under confidentiality.
Legal & safety: to comply with law, enforce agreements, or protect rights, safety, and security.
Business transfers: in connection with a merger, acquisition, financing, or sale of assets.
We do not sell your Personal Information. If we ever engage in “sharing” for cross-context behavioral advertising as defined by certain U.S. state laws, we will provide a “Do Not Sell or Share” mechanism.
9. International Transfers
We may process and store data in the United States and other countries. If you are in the EEA/UK, we rely on appropriate safeguards for transfers, such as Standard Contractual Clauses, and/or your consent where appropriate.
10. Data Retention
We retain Personal Information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. You can request deletion (see Rights below). When your account ends and no longer needs the data, we will delete or de-identify it, subject to legal/business recordkeeping requirements.
11. Security
We use technical and organizational measures designed to protect Personal Information (access controls, encryption in transit, segmentation, logging, and monitoring). No system is 100% secure; your role in safeguarding credentials, access tokens, and exported data is critical.
12. Your Privacy Rights
Your rights depend on your location and applicable law. Where available, you may have the right to:
Access and port your data.
Correct inaccurate data.
Delete your data.
Opt out of marketing emails/SMS at any time.
Opt out of certain targeted advertising or profiling.
Object to or restrict certain processing.
Appeal a decision (for certain U.S. states).
How to exercise: email [email protected] with your name, email, and request. We’ll verify your identity and respond within the time required by law. If you are a contact of a Solaria customer, please contact that customer (the controller) first; we will assist them in fulfilling your request as required.
13. Children
The Services are not for use by anyone under 18. We do not knowingly collect Personal Information from children under 18. If you believe a child provided data to us, contact [email protected] and we will delete it.
14. State & Regional Notices
California / Virginia / Colorado / Connecticut / Utah (and similar laws): We process Personal Information as a “service provider/processor” for our customers regarding their contacts, and as a “business/controller” for our own B2B data. We do not sell Personal Information. If we “share” data for cross-context behavioral advertising, we will honor opt-out choices. You may exercise rights as described in Section 12.
EEA/UK: See Sections 5 and 9 for legal bases and transfers. You may lodge a complaint with your local data protection authority, but please contact us first so we can help.
15. Third-Party Sites & Integrations
Our Services may link to or integrate with third-party services. Their privacy practices are governed by their own policies, not this one. Review those policies before enabling integrations or sharing data.
16. Customer Responsibilities (Controller Obligations)
If you are a customer, you are responsible for:
Providing required privacy notices and obtaining any necessary consents from your contacts.
Honoring opt-outs and deletion requests from your contacts.
Complying with applicable laws (e.g., CAN-SPAM, TCPA, GDPR/UK GDPR, CPRA/other state laws, CASL, ePrivacy).
We will support you as your processor/service provider under our DPA where applicable.
17. Changes to this Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the new policy and updating the “Last Updated” date above (and, where legally required, provide additional notice). Your continued use of the Services after changes become effective means you accept the updated policy.
